RIGHT OF WITHDRAWAL AND RETURN POLICY


In accordance with Article L.221-18 of the French Consumer Code, you have the right to withdraw from the sales contract with ACH CHAJAI PARIS sarl (the "Seller") for any reason and without incurring any penalty within fourteen (14) days from the date you received the products purchased from www.achchajai.paris.
You may exercise your right of return by any of the following methods, in accordance with Article L.221-24 of the French Consumer Code.
a) Online submission to the Seller of the Return Form (click here to download the form), completed in its entirety; in this case, the Seller will send you an e-mail confirming that it has received your return request.
b) Sending to the Seller of the form - to be completed in its entirety - downloaded from the www.achchajai.paris* website and conforming to the model, in accordance with Article L. 221-5 2° and the Appendix to Article R.221-1 of the French Consumer Code.
c) Sending to the Seller another statement explicitly specifying your decision to withdraw from the sales contract.
In cases b) and c), your declaration must be sent to Customer Service, at the registered office of ACH CHAJAI PARIS, having its registered office at 91 RUE SAINT HONORÉ 75001 PARIS, Paris, VAT number FR04789851177 (ACH CHAJAI PARIS). In these cases, it will be your responsibility to prove that you have duly exercised your right to withdraw from the sales contract within the prescribed period.
In accordance with Article L.221-23 of the French Consumer Code, once you have exercised your right to withdraw from the contract of sale, the products to be returned must be entrusted to a carrier within a period of fourteen (14) days from the date on which you notified the Seller of your decision to withdraw.
In accordance with Article L.221-28 of the French Consumer Code, the right to return is excluded if you have purchased personalized products or in the case of sealed items that have been opened after delivery and cannot be returned for health or hygiene reasons.

1. Conditions for exercising the right of withdrawal in accordance with Article L.121-20-12 of the French Consumer Code
The right to withdraw from the contract of sale shall be deemed to be duly exercised if all the following conditions are met :
The right of withdrawal has been duly exercised within a period of fourteen (14) days from receipt of the products by following the above-mentioned procedures.
The products must not have been used, worn or washed and, in any case, must comply with the conditions mentioned in the section on Conformity Checks below;
The identification label with the disposable seal is always attached to the products, of which it is an integral part.
Products are returned in their original unopened packaging.
The products are entrusted to the carrier within fourteen (14) days from the date on which you notified the Seller of your decision to withdraw.
The products are not damaged.
If you meet the applicable conditions, the Seller, in accordance with Article L.221-24 of the French Consumer Code, will refund you the full price of the products purchased. The only costs you will be responsible for will be the cost of returning the products, unless the Seller has expressly exempted you from this at the time of your purchase and provided that you use the carrier and shipping methods referred to below in section 2. If the returned products cannot be accepted because the above conditions are not met, you will be notified. If your return does not comply with the conditions stipulated in paragraphs a) and e) of section 1 above or with article L.221-28 of the French Consumer Code, you may choose to have the products returned at your expense. If you refuse this delivery, the Seller reserves the right to keep the products as well as the amount paid for their purchase.

2. Procedure for returning products to the Seller - UPS
The Seller recommends that you use the UPS carrier (www.ups.com) to return products. If you use UPS and the pre-printed label - which bears the return address - included in the original order if the return is offered by the Seller, you do not have to advance the return shipping costs. The Seller will pay the UPS service on your behalf and deduct from your refund the amount of the costs incurred to deliver the purchased products to you. Contact UPS to arrange the return. The ability to track a package sent by this shipping service at any time relieves you of any liability for loss or damage to the products during shipment. If you decide to return products with a carrier other than UPS, you must pay the return shipping charges and are responsible for any loss or damage to the products during transport. In this case, you will also be reimbursed an amount equal to the standard shipping costs of the products purchased but, in accordance with Article L.221-24 of the French Consumer Code, any additional costs incurred because you chose a different or faster shipping and delivery method instead of the standard method will not be reimbursed.

3. Conformity checks
Our products must be returned in their original condition and unused, in perfect condition, with all protective packaging, labels and adhesives (if applicable) attached, including all accessories and documents. We reserve the right not to accept any return of products showing signs of wear and tear, or that have been used or altered from their original condition in any way, or, as an alternative, to reduce the amount to be refunded or the value of the exchange, if applicable. For example, we may opt for a partial refund in the following cases:
the product(s) have been used, worn, damaged or washed ;
the identification label with single-use seal is not attached to the product(s) or has not been returned. Please note that the identification label is an integral part of each product; and/or
you have not returned any packaging that is an integral part of a product (for example, the dust bag, or storage bag).
You will be notified if we decide to reduce the refund amount for this reason. In this case, you may (rather than obtain a partial refund from us) choose to have the Products returned to you at your expense. If you refuse this delivery, ACH CHAJAI PARIS reserves the right to retain the products and the amount specified as a partial refund due to the loss in value of the returned products.

4. Time limits and return procedures
Once the Seller has received the returned products and verified that all conditions were met, you will receive an e-mail confirming that your return has been accepted and that ACH CHAJAI PARIS will proceed to a full refund or, if the products have lost value, you will receive an e-mail informing you of the amount deducted from the refund and announcing that ACH CHAJAI PARIS will proceed to a partial refund. Regardless of the method of payment used, the Seller will process the refund as quickly as possible and, in any event, within fourteen (14) days from the date on which it became aware of your decision to exercise your right of withdrawal and once it has ensured that the return has been made in accordance with the above conditions.
The time limit for reimbursement of the sum paid for the purchase of the returned products depends on the method of payment used.
Purchase by credit/debit card: the refund period will depend on the company that issued the card, but will normally occur within two billing cycles. The credit value date will be the same as the original debit. You will therefore not suffer any loss in terms of bank interest.
Payment by PayPal: Refunds will be credited to your PayPal account and will be visible immediately. The actual refund to the credit card associated with your PayPal account will depend on the company that issued the card.
Cash on delivery (if applicable): We will make the refund to the bank account you have indicated to us, so the refund period will depend on the accuracy of the information you have given us; refunds will generally take fourteen (14-30) days.

5. Conditions for exchanging products
In certain specific cases, duly indicated in the return form, it is possible for you to exchange the products purchased for others instead of requesting a refund.
The exchange request will be made in accordance with the provisions below:

The exchange will only be accepted for products purchased and for which the "EXCHANGE" option is provided in the Return Form ;
you will be able to request the exchange of one or more products for another of the same model, with a different size and/or color combination. In all cases, the options available for exchange will be mentioned in the Return Form;
you will be able to request the exchange of one or more products within a maximum period of fourteen (14) days from the delivery date. To do so, please fill out the Return Form and send it by e-mail to ACH CHAJAI PARIS within the above-mentioned time limits. The products to be exchanged must be given to the carrier within fourteen (14) days following the delivery date ;
only one exchange request per purchased product is accepted ;
the products you wish to exchange must be returned to ACH CHAJAI PARIS in their original packaging, unused, unworn, unwashed and undamaged. The designation label must be attached to the single-use seal;
the products to be exchanged that are part of the same order must be shipped in one go to ACH CHAJAI PARIS who reserves the right to refuse products to be exchanged from the same order but shipped in several times.

If all of the above conditions are met, once the Return Form, containing your exchange request, has been duly completed and shipped, ACH CHAJAI PARIS will process your exchange request and send you a confirmation email.

6. Deadlines and terms of exchange
Once ACH CHAJAI PARIS has received the products to be exchanged and checked that all the above conditions have been met, ACH CHAJAI PARIS will check the actual availability of the products according to the new size and/or color combination you have selected.
If the item(s) selected for exchange are not available in our stores, ACH CHAJAI PARIS will not be able to accept your request for exchange and will therefore refund the price of the product(s) purchased and for which the exchange is not available, in accordance with the terms and conditions set out in sections I and II of this information note.
If the product(s) selected for exchange are available, ACH CHAJAI PARIS will accept your exchange request and will therefore send you an email announcing the shipment of the exchanged products. The shipment will be made within thirty (30) days of your exchange request and after verification that all the above conditions have been met. The shipping costs of the exchanged products will be borne by ACH CHAJAI PARIS, which will have chosen the carrier. If the price of the product purchased is lower or higher than the product selected for exchange, no refund and/or supplement will be granted/requested for the difference. You will be contacted if your exchange request is not accepted due to non-compliance with the above conditions. In this case, you may request that the products you wish to exchange be returned to you at your expense. If you refuse this shipment, ACH CHAJAI PARIS reserves the right to keep the products and the corresponding amount for the purchase of the products.
The exchanged product(s) may in turn be exchanged in the sense and within the limits set out in sections I and II above.
Returns may be shipped by the UPS carrier indicated by the supplier, using the pre-printed adhesive label that you will find inside your package if the return is offered. This procedure will allow the supplier to make the advance payment directly to the carrier, on your behalf and subject to subsequent refund to www.achchajai.paris, of the return shipping costs and to verify at any time the whereabouts of your package. Contact UPS in order to organize the return of the products. If you decide to use, for the return of the products, a different carrier than the one indicated by www.achchajai.paris, you will have to personally pay the return costs and the responsibility in case of loss or damage of the products during transport will remain at your expense.


7. Items returned as damaged, defective or incorrect
Without prejudice to the application of mandatory consumer protection provisions, if you are returning a product because of an error on our part or on the grounds that it is damaged or defective, please notify the seller using the Return Form* on the website within thirty (30) days of receipt; if a product becomes defective after this thirty (30) day period, please contact Customer Service for further information. To return products, please refer to sections 1 and 2 above.
Seller will examine all products so returned and will notify you by e-mail of the refund within a reasonable period of time. Subject to Seller's acceptance of the damaged or defective products, products that you return because they are damaged or defective will receive a full refund, including the cost of shipping the item to your address and the cost you incurred to return the item to Seller. If the Seller finds no defect in the returned products, you will be notified that the returned products cannot be accepted and you may choose to have the products re-delivered to you. If you do not accept re-delivery, Seller reserves the right to retain the products and their purchase price and to charge you Seller's fees and commissions.


8. Identification Label
We remind you that all products sold by the Seller have an identification label with a disposable seal that is an integral part of the product. Please try the products without removing this label or seal. Products returned without the label and seal will not be accepted.

9. Consumer code
Without prejudice to the application of the mandatory provisions specified by the EU in terms of consumer protection, these conditions for the exercise of the right of withdrawal from the contract of sale are an integral part of the General Terms and Conditions of Sale and are governed by French law, in particular by the Consumer Code.
