The offer and sale of products on our website ("www.achchajai.paris") are governed by these Terms and Conditions of Sale. Products purchased on www.achchajai.paris are sold directly by H.A.G DESIGN, having its registered office at 6 RUE ALBERT MALET 75012, Paris, n° de TVA FR62988678272 (H.A.G DESIGN.sasu), capital 1000 €. You can address any request for information to our support services via Customer Service. If you need additional information, please consult the Customer Service section. 1. Our Commercial Policy
1.1 the seller H.A.G DESIGN offers products for sale on www.achchajai.paris and its e-commerce services are intended exclusively for adult end-users, i.e. "consumers".
1.2
The term "consumer" refers to any individual acting for purposes other than commercial or professional. If you are not a "Consumer", please do not make a purchase from www.achchajai.paris.
1.3
The Seller reserves the right not to process orders from any person who is not a "consumer" or orders that do not comply with its business policy, such as orders that are subject to reports or suspicions of fraudulent or illegal activities. If this is the case, the order will be considered null and void, and the Seller will inform the user of the non-performance of the sales contract.

These General Terms and Conditions of Sale exclusively govern the offer, transfer and acceptance of purchase orders related to products from the www.achchajai.paris website between users and the Seller, H.A.G DESIGN.

On the other hand, these General Terms and Conditions of Sale do not govern the provision of services or the sale of products by companies other than the Seller that are present on www.achchajai.paris by means of links, banners or other hypertext links. Before validating orders and purchasing products and services from third parties, we advise you to check their terms and conditions. The Vendor shall in no way be held responsible for the provision of services or the execution of electronic transactions between users of the site www.achchajai.paris and third parties.
2. Conditions of performance of the sales contract with the Seller in accordance with the French law no. 2014-344 of March 17, 2014 on consumption.
2.1
To execute the contract of sale of one or more products on www.achchajai.paris, you must fill out the online order form and send it to the Seller H.A.G DESIGN, by electronic means, following the instructions provided.
2.2
Before proceeding to purchase the products, please read carefully the General Terms and Conditions of Sale and the Return Policy, print a copy using the Print option and keep it for your personal use. In accordance with article L.221-5 of the French Consumer Code, prior to the purchase of your products, we will send you a summary of our commercial and contractual terms and conditions of sale, a summary of the essential characteristics of each of the products ordered and their unit price (including applicable taxes or duties), the means of payment that you may use to purchase each product, the terms of delivery of the products purchased, the shipping and delivery charges, the address and means of contact of the Seller ACH CHAJAI PARIS, as well as the date of delivery of the products. The H.A.G DESIGN Seller will also provide you with a summary of the terms and conditions concerning the return of the purchased products. If necessary, you will be informed whether the cost of returning the products is at your expense. You will be reminded of the existence of the legal guarantee of conformity of the products, we will send you the contact details of our after-sales service and will finally inform you that you have the possibility to use the platform of the European Commission for the extrajudicial resolution of disputes, accessible from the website http://ec.europa.eu/odr.

The order confirmation page, displayed immediately before the conclusion of the sales contract, also contains a reference to the General Terms and Conditions of Sale and the Return Policy, as well as a summary of the essential characteristics of each of the products ordered, the price (including any applicable taxes or duties) and the shipping costs (including any additional costs that will be charged to you if you choose a different and/or faster shipping and delivery method instead of standard delivery). The contract is deemed concluded once the H.A.G DESIGN Seller, having received your order form electronically, has verified the accuracy of the order information.
2.4
At the time of transmitting the order form, you will be informed that this transmission implies the obligation to pay the price of the products concerned. Before submitting the order form, you will also be asked to detect and correct any data entry errors.
2.5
The order form will be archived in our database for a period of time strictly necessary to process your order, and in accordance with the applicable legal deadlines. You will be able to access your order form via the My Orders section.
2.6
The language used for the conclusion of the contract with the Seller H.A.G DESIGN is French.
2.7
Once the order form has been sent, the Seller will process your order.
2.8
The Seller H.A.G DESIGN shall have the option not to proceed with orders with insufficient guarantees in terms of solvency, considered incomplete or incorrect, or in case of unavailability of products.
In this case, we will inform you by e-mail of the non-fulfillment of the contract and of the fact that the Seller ACH CHAJAI PARIS has not followed up your order, with justification. In the event that the products presented on www.achchajai.paris are no longer available or on sale at the time of receipt or execution of your order, the Seller will be required to inform you of the unavailability of the products ordered within thirty (30) days from the day following the transmission of your order to the Seller. If you have already paid for the products ordered, the Seller H.A.G DESIGN will take the necessary steps to reimburse you as soon as possible or to offer you another similar product, if this is not convenient then the contract between the parties will be considered terminated.
The Seller H.A.G DESIGN reserves the right to refuse to process orders in the cases described in sub-section 1.3.
2.9
By submitting the order form, you unconditionally accept and agree to abide by these General Terms and Conditions of Sale as part of the contract entered into by the Seller. If you disagree with certain provisions of these General Terms and Conditions of Sale, we invite you not to transfer your order form for the purchase of products to www.achchajai.paris.

By submitting your order form, you confirm that you have read and accepted these General Terms and Conditions of Sale, as well as the additional conditions indicated on www.achchajai.paris, including the conditions accessible by hypertext link, in particular the Terms of Use, the Privacy Policy and the Return Policy .
2.11
After transmission of the order form, the Seller H.A.G DESIGN will send you, by e-mail, a notice of receipt of your order, containing these Terms and Conditions of Sale, a summary of the Return Policy, as well as all the information contained in the summary of the commercial and contractual conditions that can be consulted before sending the order.
3. Warranty and indication of product prices
3.1
On www.achchajai.paris, we only offer items bearing the brand ACH CHAJAI PARIS or (Maison Ach Chajai Paris) , purchased or made directly by the H.A.G DESIGN Seller from the suppliers and/or its licensed manufacturer as well as accessories made by craftsmen.
3.2
The Seller H.A.G DESIGN does not sell any second-hand, defective or inferior products compared to the applicable market standards.
3.3
The essential characteristics of the products are presented on each of the product sheets on the www.achchajai.paris website. However, it is possible that the images and colors of the products offered for sale on www.achchajai.paris, do not correspond exactly to the real articles depending on the Internet browser and the screen used.
3.4
Product prices may vary. Before sending the order form, please check the final price indicated. If the H.A.G DESIGN Seller finds an error in the price indicated or in the calculation of the amount required at the time of payment, the ACH CHAJAI PARIS Seller will reject the order and contact the user to give him/her the opportunity to purchase the product(s) concerned at the correct price.
3.5
Purchase requests from countries not listed in the list of countries displayed on the home page cannot be accepted by the Seller H.A.G DESIGN.
3.6
All products are delivered with an identification label attached with a disposable seal.
3.7
All items sold by the Seller H.A.G DESIGN are covered by a twenty-four (24) month warranty in the event of a lack of conformity, as provided for by the legislation in force. You must inform the Seller of the existence of a lack of conformity within two (2) months from the day on which you noticed said lack of conformity. Please contact our Customer Service Department.
If an item has a lack of conformity, you may either have it repaired or replaced. If these solutions are impossible to implement or appear disproportionate, you may ask the Seller H.A.G DESIGN to apply an appropriate reduction on the purchase price or demand the termination of the contract.
4. Payment
4.1
With regard to the payment of the price of the products and the costs related to shipping and delivery, you must follow the procedures indicated in the order form. Under no circumstances will you be debited for amounts higher than the prices displayed by the SellerH.A.G DESIGN, depending on the means of payment you have chosen.
4.2
In case of payment by credit/debit card, all information (e.g., card number or expiration date) will be transferred, by means of an encrypted protocol, to banks providing remote electronic payment services, without any third party having access to it under any circumstances. This information will be used by the Seller H.A.G DESIGN only to carry out the procedures related to your purchase, or to issue refunds in case of return of the products, in accordance with your right of return, or if it proves necessary to report the occurrence of fraud to the competent authorities on www.achchajai.paris. The prices for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be debited from your account when the items are shipped.

8. Refund Timeframes and Procedures
8.1 Regardless of the payment method you used, the refund, in whole or in part, will be processed by the Seller H.A.G DESIGN as soon as possible, and in any event no later than fourteen (14) days from the day on which the Seller H.A.G DESIGN was informed of the exercise of the right of withdrawal, and after verification that the return procedure has been followed and confirmation that the returned products are in satisfactory condition.
8.2 The Seller H.A.G DESIGN will issue the refund via the payment method you used to purchase the returned products, unless you have expressly agreed with the Seller to a different payment method, and provided that the refund does not incur any additional costs for you. If the recipient of the products indicated on the order form is not the same person who made the payment for said products, in the event of exercising the right of withdrawal, the refund will be paid by the Seller, H.A.G DESIGN, to the person who made the payment.
8.3 The credit value date will be the same as the original debit date, meaning that your bank interest will not be affected.
9. Products Purchased on Pre-Order
9.1 In certain cases, the Seller will give you the opportunity to pre-order one or more products not currently offered for sale on the website www.achchajai.paris, as they are part of the upcoming new collection. Products offered for pre-order will be specifically marked on their product pages. The Seller will indicate the estimated shipping date for each item concerned and will send you a confirmation email as soon as the package is shipped. If your order contains both in-stock and pre-ordered products, they will be shipped on different dates, and you will only be charged shipping once. If your order contains only pre-ordered products, but with different delivery dates, the products will be shipped in a single package on the latest estimated shipping date.
9.2 Payment for pre-ordered products can only be made by credit card.
9.3 Unless otherwise stated in subsection 9, these General Terms and Conditions of Sale apply fully to pre-ordered products.

11. Applicable law and dispute resolution
11.1
Without prejudice to the application of the mandatory provisions specified by the EU in terms of consumer protection, the General Terms and Conditions of Sale are governed by French law, in particular the French Consumer Code.
11.2
In the event of a dispute between the Seller and a customer concerning the General Terms and Conditions of Sale that cannot be resolved through the Seller's Customer Service, the Seller accepts the possible use of alternative dispute resolution services available to consumers, as stipulated by French law (https://www.economie.gouv.fr/mediation-conso/saisir-mediateur#secteur%202).
11.3
We also inform you that the European Commission has a platform for the out-of-court resolution of disputes, accessible on the website http://ec.europa.eu/odr.
11.4
In the event of a dispute concerning the orders and/or these General Terms and Conditions of Sale, the competent court shall be considered as the court of the place of domicile or residence of the seller H.A.G DESIGN, in accordance with the applicable legislation, the court of Paris.
12. Modifications and updates
The General Terms and Conditions of Sale are regularly modified and take into account possible changes in terms of legislation. The new General Terms and Conditions of Sale will apply from the date of their publication on the site www.achchajai.paris.
